Acceptable Use Policy

This policy describes what you may not do when using Nubo. It applies to everyone who uses the Service and forms part of our Terms of Service.
1 Overview
1.1 This Acceptable Use Policy ("AUP") sets out the content and activities that are not permitted on the Nubo platform and Service ("Nubo", "we", "us", or "our"). It applies to every user and to everything you deploy, host, transmit, or do through the Service, and it forms part of and is incorporated into our Terms of Service.
1.2 Capitalized terms not defined here have the meaning given in the Terms of Service. We may update this AUP from time to time as described in those Terms.
1.3 You are responsible for ensuring that your applications, your end users, and anyone you give access to your account comply with this AUP.
2 Prohibited content
You may not use the Service to store, host, deploy, or transmit content that:
- is unlawful, or that infringes or misappropriates the intellectual property, privacy, or other rights of others;
- sexually exploits or endangers minors, or constitutes child sexual abuse material;
- is defamatory, harassing, or threatening, or that promotes violence or self-harm;
- promotes or incites terrorism, or unlawful discrimination or hatred against people based on protected characteristics;
- contains malware, ransomware, spyware, or other code intended to harm, disrupt, or gain unauthorized access to systems or data;
- is fraudulent or deceptive, or is designed to phish for or steal credentials, payment information, or other sensitive data.
3 Security and network abuse
You may not use the Service to:
- gain or attempt to gain unauthorized access to any system, account, network, or data;
- scan, probe, or test the vulnerability of any system or network without authorization, or breach or circumvent any security or authentication measure;
- launch or take part in denial-of-service attacks, or generate traffic intended to overload or disrupt others;
- intercept, monitor, or alter data or traffic that is not yours without authorization;
- forge headers or identifiers, or impersonate any person, system, or entity, including spoofing network or email source information.
4 Platform and resource abuse
You may not:
- use the Service to mine cryptocurrency, or to run workloads whose primary purpose is to consume compute, storage, or bandwidth rather than to operate a genuine application, except where we expressly permit it;
- operate open proxies, open mail relays, or anonymization or traffic-relay services intended to facilitate abuse;
- circumvent or attempt to circumvent usage limits, quotas, billing, rate limits, or access controls of the Service;
- resell, sublicense, or provide the Service to third parties except as expressly permitted, or use it to build a competing service;
- reverse engineer, decompile, or attempt to derive the source code of the Service, except to the extent that restriction is prohibited by law.
5 Email and messaging
5.1 You may not use the Service to send spam or unsolicited bulk or commercial messages, or to send messages that violate anti-spam laws such as the US CAN-SPAM Act.
5.2 You must not harvest addresses, send commercial messages without a working unsubscribe mechanism where one is required, or use false or misleading routing or header information.
6 Your responsibility for content and users
6.1 You are responsible for all content and activity on your applications and under your account, including the conduct of your end users. We do not monitor Customer Content as a general practice, and you must not rely on us to do so.
6.2 You must have all rights and consents needed for the content and data you process through the Service, and you must comply with all laws that apply to your applications and their users.
7 Self-hosted agents
7.1 When you run workloads on your own infrastructure through a Self-Hosted Agent, you remain bound by this AUP with respect to your use of Nubo's platform, dashboard, network, and services, even though the workload itself runs on your hardware.
7.2 You are responsible for the security and lawful operation of any infrastructure you connect to Nubo.
8 Enforcement
If we believe you have violated this AUP, or where we need to protect the Service, our users, or third parties, we may:
- investigate the suspected violation and access or preserve relevant data as permitted by law and our Privacy Policy;
- remove, disable, or restrict access to offending content or workloads;
- throttle, suspend, or terminate your account or the Service, with or without prior notice depending on the severity;
- report activity to law enforcement or other authorities where appropriate.
8.2 We will use reasonable efforts to give notice and an opportunity to address a violation where practicable, but we may act immediately where there is a risk of harm, legal exposure, or ongoing abuse.
8.3 Our decision not to enforce a provision in a particular case does not waive our right to enforce it later.
9 Reporting abuse
9.1 To report content or activity that you believe violates this AUP, use our abuse portal at https://www.withnubo.com/abuse or email [email protected] with enough detail for us to identify and investigate the issue.
10 Changes to this policy
10.1 We may modify this AUP from time to time. Material changes take effect as described in our Terms of Service, and your continued use of the Service after the changes take effect means you accept the updated AUP.
